Rental Conditions and Terms
Minimum and Maximum Driving Age
The minimum driving age is 22, and the maximum is 80. This condition may vary depending on the rented vehicle. If under 22, additional insurance must be purchased, with some exceptions for certain vehicles. The driver’s license must be valid and held for at least one year. An international driving permit is required for non-EU citizens. The contract allows for one free additional driver besides the primary driver, who must be listed in the contract. Any additional driver will incur a fee of 8 euros per rental.
Included in the Contract:
- Unlimited mileage
- 24-hour roadside assistance
- National taxes
- Airport delivery and pickup between 8:00 AM and 10:00 PM
- Insurance coverage (franchise or comprehensive)
Not Included in the Contract:
- Improper fuel refilling and related costs
- Extra cleaning (oil stains, tobacco, vomit, animals)
- Damage to wheels, rims, and undercarriage
- Loss of keys
- Personal belongings
- Internal vehicle damage
- Fine management
Extras:
- Child booster seat: 2 euros per day (max 35 euros) with prior notice.
- Baby seat: 2 euros per day (max 35 euros) with prior notice.
- GPS: 6 euros per day (TomTom One) with prior notice.
- Comprehensive insurance: 5 euros per day (max 105 euros).
- Insurance for wheels, rims, and undercarriage: 18 euros.
- Young driver (mandatory for under 22 years old).
- Second additional driver: 8 euros per rental.
- Out of hours: 10:00 PM to 8:00 AM.
1. Vehicle Usage
The renter acknowledges receiving the vehicle in perfect mechanical condition, equipped with the necessary documentation, tools, tires, and accessories, and agrees to keep them in good condition. Additionally, the renter agrees to:
- NOT allow others to drive the vehicle, except those authorized by carhireGO, provided they are over 22 years old and have held a driving license for at least 2 years (this condition may vary depending on the type of rented vehicle).
- Use the vehicle in accordance with traffic regulations. The renter will be responsible for any fines incurred due to violations.
- NOT tow or push any vehicle or rolling object.
- NOT allow the vehicle to be driven by individuals under the influence of alcohol or drugs, or drive in a physically impaired state due to fatigue or illness.
- NOT use the vehicle for transporting goods.
- NOT participate in competitions or sports events.
- NOT transport more passengers than legally allowed or use the vehicle for public transport of passengers.
- NOT tamper with the odometer. If done, the renter will be responsible for compensation for fraudulent use.
- Park the vehicle properly in legally designated areas.
- NOT take the vehicle out of the country.
2. Rental Charges
The rental price and deposit are determined according to the current rate. Payment is made in euros upon vehicle pickup, either in cash or by credit card. For cash payments, carhireGO will charge a deposit equivalent to the vehicle’s franchise value. The deposit will be fully refunded at the end of the rental if the vehicle is returned in perfect condition.
3. Insurance
Only the renter or drivers accepted by carhireGO are insured. The insurance policy covers third-party damages according to current legislation. The renter agrees to the policy and commits to observing its clauses and conditions, taking all necessary measures to protect the interests of the lessor and the lessor’s insurance company in case of an accident during the contract period.
Exclusions:
Insurance does not cover accidents due to alcohol or drug influence, drivers without a valid license, towing expenses for accidents or breakdowns due to driver negligence, items inside the vehicle, or damages caused by road conditions. carhireGO is not liable for accidents or property damages caused by the vehicle if the renter has provided inaccurate information about their identity, address, or license validity.
4. Accident
In case of an accident, the renter agrees to inform carhireGO within 24 hours of any accident, theft, or fire, including partial incidents, and to report to the police any bodily damage, theft, or loss. The renter must provide a declaration with the accident’s details, including location, date, time, witness names and addresses, vehicle owner’s name and address, policy number, license plate, and insurance company. The appropriate accident report must be completed with all necessary information for the company and both parties’ insurance companies if applicable.
5. Fuel
Fuel is the client’s responsibility. The vehicle must be returned with the same fuel level as at the start of the rental. If returned with a lower fuel level, the client will be charged. No refunds will be given if the tank is returned with more fuel than at the start of the contract.
6. Repairs
Normal mechanical wear and tear is covered by carhireGO (excluding damages caused by negligence, incompetence, or driver abuse). In case of a breakdown, if repairs are carried out at an external workshop (with the company’s consent), the renter must present the corresponding invoice to be reimbursed if applicable.
7. Vehicle Return
The vehicle must be returned at the specified location and date in the rental contract. To extend the contract, carhireGO must be notified 24 hours in advance. An additional fee of 18 euros applies between 10:00 PM and 8:00 AM. If the flight is delayed within this time frame, the fee will still be charged. The renter has a two-hour grace period beyond the agreed return time; otherwise, an extra day’s rate will apply. Any changes must be authorized by the company. Non-compliance allows the company to repossess the vehicle or seek judicial recovery. No refunds will be given for early returns.
8. Groups and Models
All vehicle confirmations are based on groups, not specific models. The company reserves the right to provide a vehicle with similar or superior conditions.
9. Legislation and Jurisdiction
This contract is governed by and interpreted according to Spanish laws. Any issues will be subject to the jurisdiction of consumer courts or those in the location of the obligation’s fulfillment.
10. Fines
The client is responsible for paying fines for traffic violations, improper parking, or other infractions incurred during the rental period until the vehicle is effectively returned. carhireGO will charge 30 euros (including VAT) for management and processing expenses, as the company is obliged to inform the relevant authorities of the client’s details and rental contract information within the legal timeframe. This fee does not include the fine payment.
11. Translation
Translations of these general conditions are for informational purposes only and are not legally binding in their entirety. Only the Spanish version is legally valid.
12. Data Protection
In accordance with Organic Law 15/1999, of December 13, on the Protection of Personal Data, we inform you that your personal data will be incorporated into a file owned by carhireGO to facilitate vehicle rental and/or sales services. carhireGO has adopted technical and organizational measures to ensure the security of personal data, preventing their alteration, processing, or unauthorized access, considering the technology state, the nature of the stored data, and the risks to which they are exposed, all in accordance with Royal Decree 1720/2007, of December 21, which approves the regulations implementing the Organic Law on Data Protection. We also request your consent to send you informational communications via mail, fax, or email about the products and services offered by our company. Your data will be shared, by legal mandate, with law enforcement agencies to prevent crimes and ensure national security. You can exercise your right to access, rectify, cancel, and oppose your data at any time by sending a letter to: carhireGO, calle Pirandello 20, 29004 (Málaga).
13. Conditions, Terms, and Prices
Terms, conditions, and prices are subject to change without notice. The company reserves the right to modify any of the above points if deemed necessary to ensure vehicle safety.
